Draft: under legal review
Terms
These are the draft Terms you accept inside the app before setup starts. They are being reviewed by a lawyer and aren't in force yet. Words in [brackets] are still to be filled in.
The 10 things to know (shown first, in plain words)
- It runs on your computer. Stratos Tower saves its files on your own computer (and in a cloud folder you choose, like Google Drive). We do not host or see your data.
- Your messages go to the AI companies you connect. When you ask Claude, ChatGPT, Gemini or another paid AI, your question and room notes are sent to that company under its own terms. Your free AI (Ollama) stays on your computer.
- You pay the AI companies directly. AI usage costs money. Set a spending limit here and at each company. You are responsible for every charge on your keys.
- Guard your keys like credit cards. Keep them in your password manager. Never paste them into a chat, an email or a note. If one leaks, delete it at the company right away.
- Setup changes your computer, step by step. Later, setup can install apps (like Ollama or Google Drive) and add a small helper that runs every 15 minutes. Each step says exactly what it changes, and you choose. Back up your computer before you start setup.
- AI can be wrong. AIs make mistakes and can sound sure when they are not. Check anything important. Nothing here is legal, financial, medical, tax or other professional advice.
- Nothing is sent, spent or deleted without your Yes. The board drafts; you decide. But you are responsible for what you approve and for what you send.
- Only let people you trust in. Never give your computer, your keys, your Vault folder or your accounts to anyone you do not know and trust. Shared folders (for a team or guild) are seen by everyone you share them with.
- Security changes every day. New viruses, scams and attacks appear constantly, and today's best practice can be out of date tomorrow. Our guides may already be out of date when you read them. Keeping your own computer and accounts safe is your job.
- This is a guide, not a guarantee. Stratos Tower is for information, education and a game-like way to learn. It can't promise results, and you use it at your own risk (the full Terms explain, including holding us harmless).
Safety checklist (recommended)
- My computer has a login password and locks itself when I walk away.
- My computer's disk is encrypted (Mac: FileVault is on · Windows: BitLocker or Device Encryption is on).
- My computer is backed up (Time Machine, Windows backup, or a cloud backup).
- Two-step sign-in is on for my email, my cloud folder, and every AI account I connect.
- I keep my AI keys in a password manager, not in notes or chats.
- I set a monthly spending limit at each AI company I connect.
- My computer and apps install updates (including Ollama).
- I removed browser extensions I don't know or trust (they can read pages, including this one).
- I turn on 👁 Demo mode before I share my screen.
The Terms
1. What this is, and agreeing to it
Stratos Tower (the "Software") is a beta product from [Shark Jockey Digital LLC] ("Shark Jockey," "we," "us"). It helps you organize your AI tools, files, notes, messages and decisions on your own computer, and it includes setup guides (the Basement, the setup kits and checklists), templates, starter quests, frameworks, written and spoken guidance, and any setup help we, our assistants or our partners provide (together, the "Materials"). These Terms and Disclaimer (the "Terms") apply whenever you install, set up, view or use the Software or the Materials. By checking the box and typing your name, you agree to these Terms electronically, with the same effect as a signature on paper. If you do not agree, do not use the Software or the Materials.
2. Purpose: information, education and entertainment
The Software and Materials are provided for general informational, educational and entertainment purposes, in a game-like format (floors, phases, stamps, a map) about technology and trends that change quickly. They are not a promise of any result, income, savings, security or outcome, and they are not a substitute for your own judgment or for advice from a qualified professional who knows your situation.
3. Not professional advice
Nothing in the Software or the Materials, including anything an AI produces, is legal, financial, investment, tax, accounting, medical, mental-health, insurance, cybersecurity, IT or other professional advice, and no professional relationship is created between you and us. Consult a qualified professional before acting on anything that matters to you.
4. Beta software, provided "as is"
The Software is a beta. It may contain errors, stop working, lose or damage data, or change without notice. The Software and Materials are provided "AS IS" and "AS AVAILABLE," with all faults, and without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, title, accuracy, completeness, availability, security, non-infringement, or that defects will be corrected, all of which we disclaim to the fullest extent the law allows.
5. Technology and threats change constantly; no duty to update
Software, AI models, online services, prices, best practices and security threats (including viruses, malware, scams, phishing and hacking) change constantly, sometimes daily. Any guidance in the Materials may be incomplete, out of date or wrong by the time you read it. We have no duty to update the Materials or to tell you about new risks. You are solely responsible for checking current information and for keeping your own computer, devices, accounts, networks, keys and data secure and up to date.
6. Changes to your computer and accounts
Following the setup steps may install software from other companies, change settings, create and change files and folders, run a background helper on a schedule, connect to your email, calendar, cloud storage and AI accounts, and download large files. You decide whether to take each step. You accept that these changes can cause problems, including slower performance, conflicts with other software, unexpected charges, data loss, corruption, security exposure, or damage to files, systems, devices or accounts. You are solely responsible for backing up your computer and data before you begin and at all times.
7. Other companies' services
The Software connects to services we do not own or control, including AI providers (for example Anthropic, OpenAI, Google, xAI, Perplexity, OpenRouter), Ollama and its models, Google, Apple, Microsoft, Obsidian and others ("Third-Party Services"). Your use of them is governed by their own terms and privacy policies, which you are responsible for reading and following. When you use a paid AI, the content you send (questions, room notes, documents) goes to that provider. We are not responsible for Third-Party Services, their availability, security, outputs, charges, changes, or how they handle your data.
8. Your keys, costs, accounts and actions
You use your own official accounts and keys. You are solely responsible for keeping them secret, for every charge made with them, for setting spending limits, for deleting any key that may have leaked, and for everything you approve, send, publish, buy, sign, delete or do with or because of the Software. On a Mac, keys you connect are stored in your Mac's Keychain and used only by the Tower's helper on your computer; on other computers in this beta they are stored in your web browser. Anyone or anything with access to your unlocked computer or account may be able to use them.
9. Your data, other people's data, and privacy
Your data is saved on your computer and in cloud folders you choose. We do not host your data and cannot recover it. You are responsible for what you put into the Software, including information about other people (customers, members, employees, clients, family), for having every right and consent needed to use it, and for following every privacy, data-protection, marketing and other law that applies to you. Do not put information into the Software that you may not share with the AI providers you connect, and do not use the Software for health, financial, children's or other regulated data unless you are sure that is lawful.
10. AI output
AI systems can be inaccurate, incomplete, biased, offensive, out of date or made up, and can state wrong things confidently. The "Read to me" button uses the voice already built into your computer or browser. It is not an AI, not a custom voice and not a human recording, so it can sound robotic and may mispronounce words. It is only there to help if you would rather listen than read; the written text is what counts. You alone decide whether to rely on any output, recommendation, Brief or decision, and you are responsible for checking it.
11. Security
No software, computer or network is ever completely secure. Bringing your tools and information together in one place can make that place more valuable to attackers. You are responsible for securing your computer, accounts, networks, keys and shared folders, including strong passwords, two-step sign-in, disk encryption, updates, anti-malware protection and backups, and for anyone you let use your computer or see your screen. Never give access to your computer, keys, Vault or accounts to anyone you do not know and trust.
12. Assumption of risk
You understand the risks described in these Terms and in the Materials, including risks we did not foresee, and you choose to use the Software and Materials voluntarily, with full knowledge, awareness and acceptance of those risks, including the risk of harm to your computer, systems, devices, files, data, accounts, finances, reputation and business.
13. Release
To the fullest extent the law allows, you release, waive and forever discharge Shark Jockey and the Protected Parties (section 15) from any and all claims, demands, losses and liabilities of every kind, known or unknown, arising out of or related to the Software, the Materials, Third-Party Services, setup help, or your use of any of them. If a law (such as California Civil Code section 1542) limits releases of unknown claims, you waive that law's protection to the extent you lawfully can.
14. Limitation of liability
To the fullest extent the law allows, Shark Jockey and the Protected Parties will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, revenue, business, goodwill, use or opportunity, or for any cost of replacement services or charges from Third-Party Services, arising out of or related to the Software, the Materials or these Terms, under any theory (contract, tort including negligence, strict liability or otherwise), even if told they were possible. Our total liability for all claims together will not exceed the greater of the amount you paid us for the Software in the twelve months before the claim, or one hundred U.S. dollars (US$100). These limits apply even if a remedy fails of its essential purpose. Some places do not allow some of these limits; in those places our liability is limited to the smallest amount the law allows.
15. You hold us harmless (indemnity)
You agree to defend, indemnify and hold harmless Shark Jockey and its owners, members, managers, officers, employees, contractors, setup assistants, partners, affiliates, licensors, successors and assigns (the "Protected Parties") from and against all claims, losses, damages, liabilities, fines, costs and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Software or Materials, your content and data, your use of Third-Party Services, your computer and accounts, anything you approve or send, your breach of these Terms, or your violation of any law or anyone else's rights.
16. Who may use it
You must be at least 18 years old and able to enter a binding contract, or at least 13 with a parent or guardian who accepts these Terms for you and supervises your use. The parent or guardian is responsible for any paid AI accounts, keys or charges. If you use the Software for a business or organization, you agree on its behalf and confirm you have authority to do so; it is then bound too.
17. Setup help
If we, an assistant or a partner help you set up the Software, you remain in control of, and responsible for, your computer, accounts and decisions. Assistants should never ask for your passwords or keys; you type them yourself. These Terms apply to all setup help, which is provided as is.
18. Disputes: informal first, then individual arbitration
If you have a dispute with us, you agree to first contact us at [email protected] and try to resolve it informally for at least 60 days. If it is not resolved, it will be decided by final, binding, individual arbitration under the rules of [the American Arbitration Association], not in court, except that either party may bring an individual claim in small-claims court. You and we waive any right to a jury trial and to bring or join a class, collective or representative action. You may opt out of this arbitration section within 30 days of first accepting these Terms by emailing [email protected] with your name and the words "arbitration opt-out."
19. Changes, ending, and the law
We may update these Terms; the Software will ask you to accept the new version before you continue. You may stop using the Software at any time; your files stay on your computer. These Terms are governed by the laws of [State], without regard to conflict-of-law rules; any court proceeding allowed by these Terms will be in the state or federal courts of [County, State]. If any part of these Terms is found unenforceable, it will be enforced to the maximum extent allowed and the rest stays in effect. Sections 2 through 15, 18 and 19 survive after you stop using the Software. Our not enforcing a part of these Terms is not a waiver. These Terms, together with any signed license agreement with us (which controls if the two conflict), are the entire agreement about the Software and Materials. Questions: [email protected].
